Objective liability insurance - fire & explosion

Certain businesses pose an increased risk to the public. Consider the risk of fire or explosion in buildings accessible to the public. In such cases, as an operator, you are legally required to compensate victims, even if you have not made a mistake.

The objective liability insurance for fire and explosion protects your business against the financial consequences of such claims and ensures that victims are compensated quickly and properly.

verzekering objectieve aansprakelijkheid

What is objective liability insurance?

The objective liability insurance is a legally required insurance for operators of publicly accessible establishments, such as hospitality venues, shops, sports centers, cinemas, and other locations where the public is present.

If a fire or explosion causes damage to visitors, you are automatically objectively liable. Victims do not have to prove fault.

This insurance covers the physical and material damage of third parties, regardless of your liability.

What are the benefits?

Covers physical, material, and immaterial damage to visitors after fire or explosion.

Covers your legal liability, even without proven fault.

Covers high compensation claims that could financially threaten your business.

Who is this insurance for?

This insurance is mandatory for operators of publicly accessible establishments, including:

  • Hospitality businesses (restaurants, cafés, hotels)
  • Shops and commercial enterprises
  • Sports and fitness centers
  • Cultural centers, cinemas, and event halls
  • Healthcare facilities
  • Office and commercial buildings with public reception

Are you unsure whether your activity falls under the legal requirement? Van Dessel will advise you clearly and accurately on this matter.

What is covered and what is not?

What is covered?

  • Covers bodily injury, property damage and consequential financial loss suffered by visitors following a fire or explosion
  • Compensation in accordance with the statutory limits

What is not covered?

  • Damage to your own building or its contents
  • Damage unrelated to fire or explosion
  • Contractual liabilities beyond the statutory legal framework
  • Damage caused intentionally

How much does this insurance cost?

The premium depends on various factors, such as:

  • The type of activity
  • The surface area of the building
  • The number of visitors
  • The risk profile of your establishment
  • The preventive measures you take

Because this concerns a legally regulated insurance, the coverages and minimum capital requirements are set. Nevertheless, a customised approach remains important.

Van Dessel analyses your situation and provides correct and compliant coverage at a market-based premium.

Is insurance for objective liability legally required?

Yes. For certain publicly accessible establishments, this insurance is legally required. Without a policy, you risk sanctions and personal liability.

What does “objective” liability mean?

Victims do not have to prove fault. As soon as there is damage caused by fire or explosion, you as the operator are automatically liable.

Does this insurance also cover my staff?

No. This insurance protects visitors and third parties. For staff, you need an occupational accident insurance.

What is the difference between Operational Liability Insurance and objective liability?

Public Liability covers damage caused by your activities. Strict liability specifically covers damage caused by fire or explosion in publicly accessible buildings, regardless of fault.

What happens if I don't take out this insurance?

You are breaking the law and can be held personally liable for substantial claims for damages. This can have serious financial consequences for your business.
