Civil liability after delivery insurance

Your liability does not end with the delivery of a product or the completion of a project. Damage may still occur afterwards, for which your business can be held responsible.

Post-delivery liability insurance protects you against claims for damages in cases where a delivered product or completed work later causes harm to third parties.

What is civil liability after delivery insurance?

The post-delivery liability insurance covers damage to third parties that occurs after your product has been delivered or your work has been completed.

This concerns damage that occurs after you have properly completed your assignment, but where it later becomes apparent that there was a defect, error, or shortcoming.

For example:

  • An installed component later causes damage
  • A delivered product turns out to have a manufacturing defect
  • An installation causes material damage after completion

The aggrieved party can hold you liable for the financial consequences. This insurance covers that risk.

What are the benefits?

Covers bodily injury caused by a delivered product or performed work.

Insures material damage to third parties that occurs after delivery or completion and is caused by a delivered product or completed work.

Protects your business against major expenses that threaten your continuity.

Covers the financial consequences of damage claims.

Who is this insurance for?

This insurance is essential for companies that:

  • Produce or distribute products
  • Install technical equipment
  • Carry out construction works >
  • Supply machines or parts
  • Produce custom-made products
  • Carry out industrial or technical projects

Both SMEs and larger production and installation companies face this risk.

Van Dessel analyzes your activities and determines whether post-delivery liability insurance is necessary within your liability insurance.

What is covered and what is not?

What is covered?

  • Bodily injury to third parties
  • Property damage caused by your product or work after delivery
  • Consequential loss directly resulting from the damage
  • Legal defence costs in the event of a liability claim

What is not covered?

  • The repair or replacement of your own defective product
  • Pure financial loss without bodily injury or property damage (unless otherwise agreed)
  • Intentional damage, or damage resulting from a defect that was known to you at the time of delivery
  • Contractual penalties
  • Fines for non-compliance with laws or regulations

How much does this insurance cost?

The premium is determined based on:

  • Your activity and sector
  • Your turnover or payroll
  • The type of products or works
  • Your risk profile span
  • Geographical spread (national/international)
  • Your claims history

Products with a higher risk (for example, technical installations or building components) result in a different premium compared to standard products.

Van Dessel negotiates with specialized insurers to find a balance between premium, coverage, and insured sums.

What is the difference between Public Liability during Operation and Public Liability After Delivery?

Public Liability covers damage during your daily activities. Post-Delivery Liability covers damage that only arises after your work has been completed or your product has been delivered.

Is third-party liability insurance mandatory after delivery?

No, this insurance is not legally required. However, it is highly recommended for businesses that supply products or perform work.

Am I insured if my product needs to be replaced?

No. The insurance covers damage to third parties, not the repair or replacement of your own product.

What if my product causes damage abroad?

That depends on the territorial coverage of your policy. International activities often require tailored coverage.

Does this insurance also cover purely financial loss?

By default, no. Pure financial loss is only covered if this is explicitly included in the policy.
